Terms of Purchase

The Seller warrants that they are the legal owner of the property and that it is being transferred to the Buyer free and clear of any liens or encumbrances. The Seller warrants that the above property is in good working condition.

 

Return Policy

FlyTech Trading Solutions, LLC will accept returns within 30 days of delivery receipt by Buyer, so long as the merchandise is unopened and in its original packaging. Buyer will be responsible for all return shipping costs. Shipping fees are non-refundable. A restocking fee may be charged on returned merchandise if unique componentry is purchased.

 

Limitation of Damages

In no event shall FlyTech Trading Solutions, LLC be liable for consequential damages for breach of this warranty. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to the Buyer.

 

Warranty Coverage

FlyTech Trading Solutions, LLC warrants the purchased product (“Covered Product”) to be free of all defects in material and workmanship for 365 days from the date delivered to Buyer. This warranty extends to the original buyer only, and not third-party or sequential buyers of the Covered Product.

Within the “period” of this warranty (365 days from the date delivered to the Buyer), FlyTech Trading Solutions, LLC will repair or replace, free of charge; any part proving defective in material, function or workmanship. All warranty repairs and service must be performed by an authorized FlyTech Trading Solutions, LLC technician, or at an authorized FlyTech Trading Solutions, LLC service facility.

All expenses related to replacing or repairing a defective part under this warranty shall be assumed by FlyTech Trading Solutions, LLC except for the following expenses, which shall be assumed by the buyer: transfer or shipment of the defective componentry to the repair center, if necessary.

 

Warranty Exclusions

This warranty does not apply to any costs, repairs, or services for the following:

1. Repairs necessitated by use other than reasonable and normal use as a trading computer.

2. Damage resulting from misuse, abuse, accidents, alterations, or improper installation.

3. Corrective work necessitated by repairs made by anyone other than a FlyTech Trading Solutions, LLC authorized service technician.

 

How to Obtain Warranty Service

The Buyer will notify Seller that there is a prospective Warranty Repair needed via email to crew@flytechtrading.com, with the subject line, “Warranty Service Request.” Seller will respond to Buyer within 24 hours with instructions or additional questions regarding the Warranty Service Request.

Once the service request is approved, Buyer will be given a Warranty Service Number. Buyer should carefully pack the Covered Product, preferably in the original packing materials, and deliver it, with the Warranty Service Number clearly identified on an attached paper in the packing materials, to one of the following repair and service facilities.

If the buyer sends the product by U.S. mail or shipping carrier such as UPS or FedEx, Seller recommends that the Buyer insure it and send it return receipt requested; Buyer accepts no liability for products lost or misplaced in shipment.

Upon discovery of any defect, malfunction, or nonconformity in the Covered Product, the Buyer may choose one of the following options for obtaining warranty service and repairs:

1. Service or repair the Covered Product to conform to the applicable warranty.

2. Direct the buyer to a reasonably close independent repair or service facility.

3. Replace the Covered Product with goods those are identical or reasonably equivalent to the warranted goods.

4. Refund to the buyer the original purchase price less that amount directly attributable to use by the buyer prior to the discovery of the nonconformity.

5. With written (email) pre-approval by Seller only: The buyer may secure the services of an independent repair or service facility for the service or repair of the Covered Product, when service or repair of the goods can be economically accomplished and when the buyer is not furnished appropriate relief the provisions of subparagraph In that event, FlyTech Trading Solutions, LLC will reimburse the independent repair or service facility for the reasonable cost of service and repair, including any cost for parts and any reasonable cost of transporting the goods or parts, plus a reasonable profit.

 

Notice to Buyer

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

 

Severability

If any provisions of the purchase agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

 

Applicable Law

All purchases shall be governed by the laws of the State of Florida.

 

Arbitration  

If the buyer disagrees over either's performance under the terms of this warranty, the buyer may submit the matter for resolution to a board-certified arbitrator. The buyer shall not be responsible for expenses incurred in submitting a dispute for resolution under the terms of this paragraph. The buyer is required to submit any dispute for resolution under this paragraph before pursuing any legal remedies to which he or she may be entitled.
